4BIZapp Business Terms of Service
Effective Date: October 11, 2026
1. Introduction
You and the company or business that you are authorized to represent (“you,” “your,” or “Company”) agree to these 4BIZapp Business Terms of Service and all other applicable terms, policies, and documentation (collectively, “Business Terms”) by signing up for the Services, downloading, or otherwise accessing the 4BIZapp developed for businesses (“Business Services”).
4BIZapp LLC is the contracting entity providing you our Business Services. We provide our Business Services solely for your business or commercial use.
NO ACCESS TO EMERGENCY SERVICES. Please note important differences between our Business Services and mobile phone, fixed-line telephone, or SMS services. Our Business Services do not provide access to emergency services or emergency services providers, including the police, fire departments, or hospitals, or otherwise connect to public safety answering points. Company should ensure that it can contact its relevant emergency services providers through a mobile phone, fixed-line telephone, or other service.
4BIZapp is a communication and transaction CRM for real estate professionals: calling, texting, email, chat and meetings in one inbox, with recording, transcription, AI notes and coaching, contract and deadline tracking, drip campaigns, prospecting and MLS tools. When you sign up you agree to these Business Terms. When we change them in a way that matters, we ask you to accept the new version in the app.
2. Overview of the Service
The details and features of 4BIZapp are explained at https://4bizapp.com, and help pages are at https://4bizapp.com/?show=help. Features change over time, and some depend on third-party services described in section 8.
Team Accounts. An account owner can add team members and staff (such as transaction coordinators and assistants). The account owner decides what each person can see and do, and is responsible for their use of the Service. Usage by staff is charged to whoever pays for them, as shown in the app.
Your Records. You are responsible for keeping any records your license, brokerage or the law requires you to keep. 4BIZapp helps you organize them, but it is not a records retention service for your brokerage and does not replace your brokerage's systems.
3. Pricing, Payment and Credits
No Monthly Subscription. 4BIZapp has no monthly subscription or per-user fee. You pay for what you use, as described in this section and on our pricing page at https://4bizapp.com.
Activation Fee. A one-time account activation fee is charged when you sign up, after your phone number is verified. The amount, and the part of it that is added to your account as starting credits, are shown on the sign-up page before you pay. Team members and staff invited by an account that pays for them do not pay this fee.
Usage. Calls, texts, emails, transcription, AI features, storage, owner phone lookups and other usage are charged from your account's credit balance at our cost plus a markup (currently 15%), or at the fixed per-item price shown on our pricing page. Your usage and the price of each item are shown in Billing.
Phone Numbers. Each active 4BIZapp phone number has a monthly fee shown on our pricing page, charged from your credit balance.
Transaction Fee. A flat software fee is charged for each transaction you run in 4BIZapp, as described in section 4.
Credits and Automatic Top-Up. Usage is paid from prepaid credits. When your balance falls below the level shown in Billing (currently $25), we charge the card on file to add credits (currently $100), so your service keeps working. By adding a card you authorize these charges. Credits have no cash value, cannot be transferred, and are not refundable except where the law requires or these Business Terms say otherwise.
Failed Payments. If we cannot charge your card when your balance is low, features that cost money may pause until a working card is added. If an amount stays unpaid, we may suspend or close your account and seek collection of the amount owed.
Price Changes. We may change prices. We will give you at least 30 days' notice of an increase by email or in the app, and the new price applies to usage after it takes effect. Your continued use after that date is your agreement to the new price.
Taxes. Prices do not include taxes. You are responsible for any taxes that apply to your purchases, other than taxes on our income.
4. Transaction Fee
How It Works. A flat software fee is charged for each transaction you run in 4BIZapp. A transaction is a deal side in your account that goes under contract (for example, an accepted purchase contract filed in your account, or a deal marked pending or closed). Each side counts once, so representing both the buyer and the seller is two transactions. The standard fee is shown on our pricing page. The fee that applies to you is shown in Settings, Billing, and may differ if we agreed to a different rate with you in writing.
When It Is Charged. Transaction fees are charged from your credit balance on the monthly bill after the month the transaction went under contract, to whoever pays for the agent on the transaction. The fee does not depend on the outcome: it is the same whether the transaction closes, is cancelled or is still open.
Not a Transaction. If a fee was charged for something that is not one of your transactions (for example, a duplicate deal, another agent's deal, or a document filed only for reference that never went under contract), press "Not a transaction" in Billing. The fee is refunded to your balance and the deal is flagged for review. Repeated disputes may be reviewed before a refund. If our review shows it was one of your transactions, we will tell you and may charge the fee again.
Deals Shared With You. A deal copied into your account from another agent's invitation, for a transaction that closed before you joined, is never charged.
What the Fee Is For. The transaction fee is a fee for the software services you use to manage the transaction, like the other prices in section 3. It is not contingent on a closing, it is not a commission or a share of any commission, it is not payment for the referral of any client or business, and it is never paid from your client's funds. 4BIZapp does not refer clients to you and does not receive payments from lenders, title companies or other settlement service providers for your transactions.
Earlier Closed-Deal Fees. Before October 11, 2026, a fee was charged per closed transaction instead. A deal that already paid that fee is not charged again.
5. Agent Invitations
How It Works. When a transaction in your account closes, 4BIZapp invites the real estate agent who represented the other side of that transaction to try 4BIZapp, unless that agent already uses 4BIZapp, has opted out, or has no email address in the transaction documents. The invitation is sent about 3 days after the close, or sooner if you press Send now on the deal.
Sent on Your Behalf. Each invitation is sent by 4BIZapp in your name (for example, "Jane Agent via 4BIZapp"), from a 4BIZapp email address, with replies going to you. By using the Service you authorize 4BIZapp to send these invitations on your behalf. Invitations are a standard part of the Service and are one of the main ways 4BIZapp grows without charging a monthly fee, which keeps prices low for everyone. Unless your account settings offer a way to turn invitations off (which may come with a different transaction fee, shown before you choose), invitations are sent automatically.
What the Other Agent Sees. The invitation links to a read-only preview of the transaction as the other agent would already know it: the purchase contract and its addenda, dates and deadlines, the names of the parties, and the messages between you and that agent. It never includes your client's contact details, your notes, AI summaries, recordings or your commission. If the other agent signs up, a copy of that information is placed in their own account.
Your Notice and Credit. You get a notification each time an invitation is sent. When the agent you invited signs up and starts using 4BIZapp (their activation fee is paid), you receive an account credit (currently $50, shown in Settings, Agent invites). Credits are added to the account that pays for you, have no cash value, and are reversed if the new account's payment is refunded or reversed.
Recipient Choices. Every invitation includes a one-click link to stop future invitation emails, which we honor for all future invitations to that address, and our postal address. An address that received an invitation is not sent another one for at least 14 days.
Your Responsibility. You confirm that you may share the other agent's business contact information from your transaction documents for this purpose. If a confidentiality agreement or brokerage policy does not allow an invitation for a specific transaction, contact support@4bizapp.com before it is sent and we will stop it.
6. Recording, Transcripts and AI
What Is Recorded. Calls made or received through your 4BIZapp phone numbers, meetings you schedule through 4BIZapp with a connected Zoom or Google account when recording or transcripts are turned on, and recordings you upload may be recorded, transcribed and summarized by the Service.
Consent. Recording laws differ by state and country, and some require every person on a call or in a meeting to agree. 4BIZapp uses the state on your account to decide when calls are recorded automatically (one-party consent states), adds a "may be recorded" notice to meeting invitations when recording is on, and asks you to confirm consent when you upload a recording. You are responsible for getting any consent the law requires from everyone you record, and for following your brokerage's rules. By signing up, you consent to the recording of your own calls and meetings made through the Service.
Recordings With Other 4BIZapp Users. If a call or meeting is with another 4BIZapp user, the recording is available to each user from their own account.
Copies for Others. Call participants who are not 4BIZapp users may have the right to receive a copy of a recording under applicable law or your recording preferences, and may receive an automated email with the recording.
Keeping Recordings. Audio, transcripts and AI notes are kept for the life of your account, unless you delete them, and are removed as described in section 19 when your account ends.
AI Features. 4BIZapp uses third-party AI services to transcribe calls and meetings, write notes and summaries, score trust and sentiment, coach you during outbound calls when you choose "Continue with Coaching," and suggest message drafts. AI output can be wrong or incomplete. Review it before you rely on it or send it, and never use it as legal, tax or financial advice. We do not use your content to train AI models, and the AI services we use do not use your content to train their models.
7. Messaging, Calling and Prospecting Rules
Your Compliance. You are responsible for following every law and rule that applies to your calls, texts and emails, including the Telephone Consumer Protection Act, the Telemarketing Sales Rule, national and state Do Not Call rules, CAN-SPAM, state telemarketing and texting laws, carrier rules for business texting (including A2P 10DLC registration), real estate license law, and your MLS's and brokerage's rules on advertising and contact.
Consent and Opt-Outs. Only text or autodial people who have given any consent the law requires. Requests to stop (such as STOP replies or unsubscribe links) are honored automatically, and you must not try to get around them.
Prospecting Data. Prospecting tools such as expired listings and owner phone lookups use data from your MLS and from third-party data providers. This data may be incomplete or out of date. Before calling or texting a number from these tools, you must check it against the Do Not Call registries where the law requires and keep any records the law requires. 4BIZapp may limit how many prospecting calls or texts you make in a day to help protect you and our phone numbers.
Carrier Fees and Registration. Carriers charge registration and other fees for business texting. These may be passed through to you as shown in Billing, and texting may not work until registration is approved.
8. Connected Accounts, MLS Data and Other Services
Google and Zoom. When you connect a Google or Zoom account, you authorize 4BIZapp to access it with the permissions shown when you connect, only to provide the features you use (such as creating meeting links and calendar invitations, and bringing recordings and transcripts into your account). How we use this data is explained in our Privacy Policy at https://4bizapp.com/?show=pp. You can disconnect at any time in Settings or in your Google or Zoom account.
MLS Data. MLS features use your own MLS membership and credentials, or a data feed your MLS licenses to you. You are responsible for having that authorization and for following your MLS's rules and license terms, including who may see the data. 4BIZapp shows MLS data only to you and the team members you allow.
Other Services. Your use of Google, Zoom, your MLS, your email provider and other third-party services is also governed by their own terms and privacy policies.
9. Phone Numbers
Any phone numbers provided to you or your business by 4BIZapp are for use while you use the 4BIZapp service, and act as a gateway to the services they are associated with. None are intended to be a permanent number or replacement for any phone number used, leased or owned by your business. Numbers are subject to change, and a number on an account that is closed or unpaid may be released and may not be recoverable. Where the carrier allows it, you may ask us to help move a number to another provider.

If you do not wish for 4BIZapp to communicate with you regarding (c) above, you may opt-out of future communications by following the “unsubscribe” link or instructions in any such communication. Some communications can also be disabled directly from an authorized account user’s preference control panel.

Please note that when Company uses these other services, their own terms and privacy policies will govern Company’s use of those services. 4BIZapp will not be responsible or liable for your use of those services, the third-party’s terms, or any actions you take under the third-party’s terms.
